摘要:
近几年，行政执法检察监督方兴未艾，理论界也大有争议，多数学者认为其源于宪法上“各级人民检察院是国家的法律监督机关”的规定。然而无论是深究法律监督权的产生及其发展的全过程，还是细察检察机关的权力属性，都无法从中找到法律依据。应该从宪法的整体规定出发而不是片面地以“法律监督者”角度理解检察机关的监察权，行政执法检察监督也不是宪法、法律赋予检察机关的主业，以检察权监督审判权的制度安排来鞭策依法行政才是行政诉讼检察监督的真意所在，行政执法检查监督也才有合法存在的可能。
Abstract:
In recent years, the supervision of administrative law enforcement developed rapidly, and it was also intensely debated by thetheoretical circle, most scholars believe it is the result of a constitutional " the people’s procuratorate at all levels is the national legalsupervision organ ". Yet neither delves into the whole arising and developing process of legal supervision, nor look into the power propertyof procuratorial organs, can we find a legal basis. We should set out from the whole constitution rather than one-sided understanding of"watchdog" to look upon the procuratorial organ’s right of supervision, and the procuratorial supervision of administrative law enforcementis not its primary mission required by the constitution. Using the procuratorial supervision to supervise the judicial authority is just the truevalue of the procuratorial supervision of administrative litigation, and also there is a possibility of administration and law enforcementsupervision’s legal existence.
